1. Introduction
Bazanova Art ("Bazanova Art," "we," "us," or "our"), a Florida limited liability company, operates the website art-bazanova.com and the online learning platform painting.eduonline.io (collectively, the "Services"), through which we offer online painting and visual art courses, master classes, and related educational content.
This Privacy Policy explains what personal information we collect, how we use and share it, the choices and rights you have, and how we protect your information. It applies to visitors, students, customers, and other users of the Services. It is supplemented by our Data Policy, available at art-bazanova.com/datapolicy, which describes our operational data-handling practices in greater detail.
By accessing or using the Services, you agree to this Privacy Policy. If you do not agree, please do not use the Services.

3. Information We Collect
We collect personal information in three ways: (a) information you provide directly to us, (b) information collected automatically when you use the Services, and (c) information received from third parties.
3.1 Information You Provide
• Account & registration data: full name, email address, password, mailing address, phone number, and date of birth.
• Order & payment data: purchase history, billing address, course and tier selected, and transaction identifiers. Payment card details are entered on our payment processor's page and are not stored on our servers.
• Student-generated content: photographs of your artwork, homework submissions, chat messages, and any other content you upload to the platform or share in student community channels.
• Customer-support data: records of your communications with us by email, web form, chat, or phone.
• Marketing preferences: consent choices for newsletters, promotional emails, and similar communications.
3.2 Information Collected Automatically
• Device & log data: IP address, browser type and version, operating system, device identifiers, referring URL, and dates and times of access.
• Usage data: lessons viewed, modules completed, time spent, clicks, and other engagement metrics on the platform.
• Cookies & similar technologies: see Section 8 (Cookies and Tracking Technologies) below.
3.3 Information from Third Parties
We may receive limited information from payment processors (e.g., confirmation that a payment cleared), analytics providers, advertising partners (including Meta/Facebook and Google Ads), and social media platforms when you interact with our content there.
4. How We Use Your Information
We use personal information for the following purposes:
• To create and maintain your account and provide access to the courses and platform features you purchased.
• To process payments, issue refunds, and prevent fraudulent transactions.
• To deliver, personalize, and improve the Services, including curriculum, recommendations, and customer experience.
• To communicate with you about your account, orders, schedule changes, technical notices, security alerts, and support requests.
• To send marketing and promotional communications, where permitted by law and subject to your preferences.
• To deliver targeted advertising on third-party platforms, including Meta (Facebook and Instagram) and Google, and to measure the performance of those ads. See Section 8A for details.
• To use artificial intelligence and automated systems to personalize learning, recommend courses, and improve our Services. See Section 8B for details.
• To moderate community spaces and enforce our Terms of Service and Studio Rules.
• To comply with legal obligations, respond to lawful requests, and protect our rights, property, and the safety of our users.
• To conduct analytics, research, and business operations such as accounting, audits, and corporate transactions.
5. Legal Bases for Processing (Where Applicable)
Where required by law, we rely on the following legal bases to process your personal information: (i) performance of a contract (e.g., delivering a course you purchased), (ii) your consent (e.g., marketing emails, targeted advertising), (iii) our legitimate interests (e.g., fraud prevention, service improvement), and (iv) compliance with legal obligations (e.g., tax recordkeeping). You may withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.
6. How We Share Your Information
We do not sell your personal information for money. However, for purposes of California law (CCPA/CPRA) and equivalent state privacy laws, our use of certain advertising and analytics tools may constitute "sharing" of personal information. See Section 8A and Section 12 for how to opt out. We share information only as described below:
• Service providers: payment processors, hosting and infrastructure providers, learning platform vendors (including the operator of painting.eduonline.io), email and SMS delivery services, analytics tools, customer-support tools, and advertising platforms (including Meta/Facebook). These providers are contractually required to safeguard your information and use it only to provide services to us.
• Instructors and course administrators: limited information necessary to deliver instruction, evaluate assignments, and operate student communities.
• Professional advisors: attorneys, accountants, and auditors, where reasonably necessary.
• Legal & safety disclosures: when we believe in good faith that disclosure is required by law, court order, or governmental request, or is necessary to protect rights, property, or safety.
• Business transfers: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, in which case personal information may be transferred to the successor or acquirer.
• With your consent or at your direction: for example, when you publish your artwork to a public student gallery or social media.
7. Information About Other People; Public Content
If you submit a review, post in a community channel, or otherwise share content on the Services, that content may be visible to other users. Do not post personal information about others without their permission. Content you make public is no longer private and we cannot control how others may use it.
8. Cookies and Tracking Technologies
We use cookies, web beacons, pixels, SDKs, and similar technologies to operate the Services, remember your preferences, analyze traffic, and deliver relevant marketing. Cookie categories we use:
• Strictly necessary: required for login, security, and core functionality. These cannot be turned off.
• Functional: remember your settings and preferences.
• Analytics: help us understand how users interact with the Services (e.g., Google Analytics, Yandex Metrica).
• Advertising / targeting: allow us and our partners to deliver relevant ads and measure their performance (e.g., Meta Pixel, Google Ads pixel, VK Ads pixel). See Section 8A for details.
You can control cookies through your browser settings and through any cookie banner we display. Disabling cookies may affect functionality.
We honor recognized opt-out signals, including the Global Privacy Control (GPC), where required by applicable law. Advertising and analytics pixels are loaded only after you have provided consent or, where applicable, have not opted out, consistent with our cookie banner and applicable law.
8A. Third-Party Advertising and Meta (Facebook) Integration
We use third-party advertising platforms, including Meta (Facebook and Instagram), Google Ads, and others, to deliver targeted advertising and measure campaign performance.
8A.1 Meta Pixel and Conversions API
We use the Meta Pixel and/or Conversions API (CAPI) on our website. These tools collect and transmit the following data to Meta: IP address, browser and device information, page URLs visited, conversion events (e.g., course purchases, registrations), and, where Advanced Matching is enabled, hashed email addresses and phone numbers from form submissions. This data is used for retargeting, conversion measurement, and audience building on Meta platforms.
8A.2 Other Advertising Platforms
We may also use Google Ads, TikTok Ads, and VK Ads pixels or similar tools. These platforms collect similar categories of data (IP address, device information, pages visited, conversion events) for ad delivery and measurement.
8A.3 Sharing and Your Opt-Out Rights
Sharing data with Meta and other advertising platforms for targeted advertising constitutes "sharing" as defined under CCPA/CPRA and equivalent state privacy laws. You have the right to opt out of this sharing at any time:
• Click the "Do Not Sell or Share My Personal Information" link on our website.
• Email info@art-bazanova.com with the subject line "Do Not Share."
• Enable the Global Privacy Control (GPC) signal in your browser.
Upon receiving an opt-out, we will display a confirmation ("Opt-Out Request Honored") and apply Meta's Limited Data Use (LDU) flag to restrict processing of your data by Meta. We will also exclude you from Custom Audiences and stop firing advertising pixels for your sessions.
8A.4 Custom Audiences
We may upload hashed customer contact lists (email addresses, phone numbers) to Meta to create Custom Audiences for advertising. We only upload data from customers who have not opted out of marketing or data sharing. Customer data is hashed (SHA-256) before transmission. We maintain documentation of the consent basis for each Custom Audience.
8B. Artificial Intelligence and Automated Decision-Making
We use artificial intelligence (AI) and automated systems to enhance your learning experience and improve our Services. This section explains how we use AI with your personal data.
8B.1 How We Use AI
• Course recommendations: analyzing your learning progress, preferences, and engagement to suggest relevant courses and content.
• Content personalization: adapting learning materials, difficulty levels, and pacing based on your individual performance.
• Automated support: AI-assisted customer support tools (chatbots, ticket routing) that may process your inquiries.
• Analytics and insights: aggregating and analyzing user behavior to improve curriculum design and platform functionality.
• Fraud detection and security: automated systems to detect suspicious activity and protect user accounts.
8B.2 Profiling
We may use profiling — automated processing of your personal data to evaluate or predict aspects such as preferences, interests, behavior, or performance. Profiling is used solely to personalize the learning experience and improve our Services, not to make decisions that produce legal or similarly significant effects on you.
8B.3 AI Training Data
We may use de-identified and aggregated user data to train and improve our AI models. We do not sell your personal data to third parties for AI training purposes. We do not use sensitive personal information for AI processing without your affirmative consent where required by applicable law.
8B.4 Your AI Rights
• Right to opt out of profiling: You may opt out of profiling that produces legal or similarly significant effects by contacting info@art-bazanova.com. Routine personalization and recommendation features do not constitute significant profiling.
• Right to know: You may request information about the categories of personal data processed by our AI systems.
• Right to human review: Where an automated decision produces a significant adverse effect on you, you may request human review by contacting info@art-bazanova.com.
• Right to correct: You may correct inaccurate personal data used in automated processing.
9. Data Retention
We retain personal information only for as long as needed to provide the Services and comply with legal obligations. Typical retention periods:
• Account & course access records: for the duration of your access to the course (typically 1–2 years from purchase) plus up to 3 years thereafter.
• Course progress and certificates: minimum of 5 years to support credential verification.
• Transaction and tax records: at least 7 years to comply with U.S. tax and accounting requirements.
• Customer-support correspondence: up to 3 years from the last interaction.
• Marketing data: until you unsubscribe or withdraw consent, plus up to 3 years for suppression-list purposes.
• Data subject request records: minimum of 24 months, as required by applicable state law.
• Backups, logs, and security telemetry: up to 12 months, on rolling deletion cycles.
Deletion requests are honored in production systems immediately and propagated to backups on the regular rotation cycle.
10. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including TLS 1.2+ encryption in transit, AES-256 encryption at rest for sensitive fields, role-based access controls, multi-factor authentication on administrative accounts, and vendor due diligence. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. If you believe your account has been compromised, contact us immediately at security@bazanova.art.
11. Your Privacy Rights
11.1 Rights Available to Residents of California, Florida, and Other U.S. States
Depending on where you live, you may have the following rights with respect to your personal information:
• Right to know / access: request confirmation of whether we process your personal information and obtain a copy of it.
• Right to correct: request correction of inaccurate personal information.
• Right to delete: request deletion of your personal information, subject to legal exceptions.
• Right to data portability: receive your personal information in a portable, readable format.
• Right to opt out of sale or sharing: opt out of the sale of your personal information and of sharing for cross-context behavioral advertising, including sharing with Meta and other advertising platforms.
• Right to opt out of targeted advertising and profiling: opt out of certain automated decision-making and profiling that produces legal or similarly significant effects.
• Right to non-discrimination: we will not deny you services, charge different prices, or provide a different level of quality for exercising your rights.
• Right to appeal: if we deny your request, you may appeal by replying to our decision; we will respond within the period required by your state's law.
11.2 How to Exercise Your Rights
Submit a request by emailing info@art-bazanova.com or by writing to the address in Section 2. We will verify your identity using information you have provided to us, then respond within the timeframes required by applicable law (generally 45 days, extendable once for an additional 45 days).
You may use an authorized agent to submit a request on your behalf, subject to verification of the agent's authority. We honor opt-out requests from authorized agents and recognized opt-out preference signals, including Global Privacy Control (GPC).
11.3 Notice of Financial Incentives
We do not currently offer financial incentives or price differences in exchange for personal information.
11.4 "Shine the Light" (California)
California Civil Code Section 1798.83 permits California residents to request information about the disclosure of personal information to third parties for direct marketing purposes. We do not share personal information with third parties for their direct marketing purposes.
12. Do Not Sell or Share My Personal Information
We do not sell your personal information for money. However, we do share certain personal information with advertising partners (including Meta/Facebook and Google) for targeted advertising purposes, which may constitute "sharing" under CCPA/CPRA and equivalent state privacy laws.
To opt out of the sale or sharing of your personal information (including for cross-context behavioral advertising):

• Use the "Do Not Sell or Share My Personal Information" link on our website.
• Enable the Global Privacy Control (GPC) signal in your browser.
We will display a confirmation ("Opt-Out Request Honored") upon receiving your opt-out request. We will not process your personal information in a manner inconsistent with a valid opt-out request after it has been received and verified.
13. Children and Minors
The Services are intended for adults. We do not knowingly collect personal information from children under 13, and we do not direct the Services to children under 13, in compliance with the Children's Online Privacy Protection Act (COPPA). If we learn that we have collected personal information from a child under 13, we will promptly delete it. Parents and guardians who believe their child under 13 has provided us with personal information should contact us at info@art-bazanova.com.
We may permit individuals between the ages of 13 and 17 to use the Services with the consent and supervision of a parent or legal guardian. A parent or legal guardian must complete enrollment, agree to our Terms of Service and this Privacy Policy, and remain responsible for the minor's use of the Services. Minors and their guardians may exercise the rights described in Section 11 at any time.
We do not knowingly sell or share for cross-context behavioral advertising the personal information of consumers under 16 without the affirmative consent required by applicable law, including the laws of California (CCPA/CPRA), Connecticut (CTDPA), Oregon (OCPA), and other states with enhanced protections for minors. We do not engage in targeted advertising directed at minors under 18 where prohibited by applicable state law, including Maryland's Online Data Privacy Act (MODPA).
14. International Users and Data Transfers
We operate from the United States. If you access the Services from outside the United States, you understand that your personal information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. Where required, we use appropriate safeguards for international transfers (such as Standard Contractual Clauses or equivalent mechanisms).
15. Third-Party Links and Services
The Services may contain links to third-party websites, plug-ins, and services. Their privacy practices are governed by their own privacy policies, and we are not responsible for their content or practices.
16. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the updated version on the Services and update the "Last Updated" date above. If the changes are material, we will provide additional notice (such as by email). Your continued use of the Services after the effective date constitutes acceptance of the updated policy.
17. Applicable Law
This Privacy Policy is governed by the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict-of-laws principles. We additionally comply with the privacy laws of other U.S. states that apply to our processing, including, where applicable, the California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA), Texas Data Privacy and Security Act (TDPSA), Colorado Privacy Act (CPA), Connecticut Data Privacy Act (CTDPA), Virginia Consumer Data Protection Act (VCDPA), Oregon Consumer Privacy Act (OCPA), Maryland Online Data Privacy Act (MODPA), and other applicable state privacy laws as enacted and amended.
